1. Vendors are required to maintain their booth in good order and to staff said booth at all times during the opening hours of the market.
2. The Market Manager may alter or move booths at their own discretion
3. Vendors may only share a booth space if permission is given in writing to at least one of the Vendors who will be sharing the space.
4. The Market Manager may prohibit the sale of any item(s) of any Vendor, which in the Market Manager's sole judgement are deemed to be not appropriate for any reason.
5. If a Vendor cancels their participation without adequate notice or does not show up on a market day, participation and rental fees are non-refundable. Cancelations must be made by email with a minimum 10 day notice before the market is scheduled to open to qualify for a refund.
6. No refunds will be given due to inclement weather unless the market is cancelled by Russell Flea
7. If, in the sole opinion of Russell Flea or the Market Manager, a market becomes unadvisable for any reason, Russell Flea
reserves the right to cancel the market at any time and return all participation and rental fees for the cancelled market date paid up to that time to the Vendor.
8. Vendors assume all responsibility for their items/property used in connection with the market. Furthermore it is understood and agreed that Russell Flea, Matthew Hiemstra, and Lianne Hiemstra are expressly released and discharged from any and all liabilities, loss, injury or damage to either persons or
property that may be sustained on or about the premises of the Market or in connection with the
Market.
9. Vendors shall maintain such insurance as will fully protect them from any and all claims and
shall pay any claims for damages, including personal injury, which may arise from the operations of
the Vendor. Furthermore, Vendors agree to pay all costs for damages which they may cause to
the building or grounds containing the Market.
10. Vendors are required to hold all necessary licenses required for their business.
11. Should a Vendor breach, at any time, any of the conditions listed above, Russell Flea and the Market Manager have the right to dismiss and evict the Vendor from the market. Any payments made by the Vendor shall be retained by Russell Flea as liquidated damages for such breach.
12. Purchase of market day participation for any of the market days indicates a Vendor's full acceptance of these terms and conditions.
13. Should any part of these terms and conditions be inadmissible or faulted, the rest of the term or condition and agreement shall remain intact.
14. This agreement shall be binding upon the Vendor and Russell Flea and their respective executors, administrators, successors and assigns.
